THIS AGREEMENT made this by and between AFFORDABLE HOME INSPECTION CO. (hereafter called the company) and  (hereafter called the client).
1.      This inspection of the subject property shall be performed by the company for the Client in accordance with the Standards of Practice of the State of Arizona and the American Society of Home Inspectors, Inc. (ASHI), a copy which is attached.
2.      The purpose of this inspection in accordance with the Arizona State Standards is to identify and disclose visually observable major deficiencies of the inspected systems and items at the time of the inspection only.
3.      This inspection is not intended to be technically exhaustive nor is it considered to be a GUARANTEE OR WARRANTY, EXPRESSED OR IMPLIED, REGARDING THE CONDITIONS OF THE PROPERTY, ITEMS AND SYSTEMS INSPECTED AND IT SHOULD BE RELIED ON AS SUCH. Neither the company nor its inspector shall be held responsible or liable for any repairs or replacements with regard to this property, systems, components, or the contents therein. 4.      THE INSPECTION AND REPORTS DO NOT ADDRESS AND ARE NOT INTENDED TO ADDRESS THE POSSIBLE PRESENCE OF OR DANGER FROM ASBESTOS, RADON GAS, LEAD PAINT, UREA FORMALDEHYDE, however, testing for these items may be performed if specifically ordered and paid for by the client. For soil contamination and other indoor and outdoor pollutants, toxic or flammable chemicals, water or airborne related illness or disease, and all other similar or potentially harmful substances and conditions the client is urged to contact a competent specialists. In addition, the presence or absence of rodents, termites and other insects are also not covered by this inspection.
5.      IT IS UNDERSTOOD AND AGREED THAT SHOULD THE COMPANY AND/OR ITS AGENTS OR EMPLOYEES BE FOUND LIABLE FOR ANY LOSS OR DAMAGES RESULTING FROM A FAILURE TO PERFORM ANY OF ITS OBLIGATIONS, INCLUDING, BUT NOT OTHERWISE, THEN THE LIABILITY OF THE COMPANY OR ITS AGENTS OR EMPLOYEES SHALL BE LIMITED TO A SUM EQUAL TO THE AMOUNT OF THE FEE PAID FOR THE INSPECTION REPORT.
6.      This inspection and report are performed and prepared for the sole, confidential and exclusive use and possession of the client. The company assumes no responsibility or liability to any third parties in connection with the inspection or report. This report is non-transferable.
7.      Statute of limitations: Any claims must be presented in writing within one(1) year of the date of the inspection. The company shall have no liability for any claims presented one (1) year after the date of the inspection.
8.      Arbitration: Any and all disputes between the parties, whether in contract or tort, shall be settled by binding arbitration before the Construction Arbitration Association, and any reward rendered thereon shall be submitted to a Court of competent jurisdiction.
9.      The inspection service is conducted at the property. The physical on-site inspection of the property is a very valuable time of exchange of information between the company and the client. Any particular concern of the client must be brought to the attention of the company before the inspections begins. The written report will not substitute for clients personal presence during the inspection. It is virtually impossible to fully profile any building with any reporting system. Unless client attends and participates in the inspection process itself, the client will have no chance of gaining all the information that is offered. Company strongly encourages clients attendance and participation. Almost all clients find accompanying the companys inspector an invaluable learning experience. As a result, most are better able to understand the results of the inspection.
